CONTENTS AND RESPONSIBILITY

In particular, in the case of low-cost airlines, the use by the WEBSITE client for the location of flights for the purpose of hiring implies the direct submission of the client to the general conditions of said airlines and the general conditions of the websites of each of them, including those corresponding to personal data protection.

The USER agrees to accept and respect the terms and conditions of purchase established by the supplier with whom the reservation is made. These conditions may include the payment of any accrued amounts and compliance with any rules and restrictions on the availability of rates, products or services.

Touristair makes available to consumers and users an informative program or brochure that contains in writing the corresponding offer on the combined trip and that must include a clear, understandable and precise information about the destinations and means of transport, with mention of its characteristics and class, duration, itinerary and travel calendar.

The suppliers of products or services and the organizers / wholesalers that organize the combined trip, each within the scope of their respective obligations, will be responsible to the USER for complying with the obligations arising from the regulations in force and the conditions of sale of each of the products and services or combined trips that are contracted, without Touristair assuming any obligation or responsibility with respect to those products or services that it does not provide directly.

The traveler is responsible for complying with the government requirements for departure, entry and other documentation. Touristair may incorporate additional specific conditions that will be recorded on the WEBSITE.

PURCHASE PROCESS AND PAYMENT METHODS

On the WEBSITE the reservation can be made in Spanish. Most of the fields are free, so that the WEBSITE does not have the means to identify and correct errors in the introduction of the data, for this reason it will be the responsibility of the USER any error made when entering said data.

The document in which the contract is formalized through which the client acquires any tourist product or service through the WEBSITE will be sent to the USER by email. In this email you will be given the information regarding the products and / or services contracted, your locator number, all the indications regarding the payment method, cancellation conditions, other useful information and, where appropriate, the sending of the Travel documentation.

The purchase of any product will only be effective at the moment Touristair makes the charge in a valid way depending on the payment method chosen, and until that moment it can be canceled by Touristair.

The available means of payment are:

PAYMENT WITH CREDIT OR DEBIT CARD. In the debit cards the amount charged is automatically withdrawn from the associated account, in the credit cards the USER can have money without having funds in the associated account, and the amount is normally charged at the beginning of the month following the purchase.

ORDINARY BANK TRANSFER. Once the reservation has been made on our website, you must make a transfer within the next 24 working hours for the amount accepted. In the concept of the transfer you must include the locator that we will provide at the end of this reservation. PAYPAL We connect with PayPal where you must log in with your user to proceed with the payment. We recommend paying with PayPal because it is one of the safest forms of payment.

DIRECT PAYMENT AT THE HOTEL. The USER may make the payment directly at the hotel when this is specifically provided for that type of service. Touristair will ask for your credit card information ONLY AS A GUARANTEE. The hotel may only use this information to charge cancellation fees in cases of cancellation of the reservation or no show at the hotel establishment.

Not all of these payment options are activated, it will depend on the type of product and the advance with which you make the reservation.

The fact of requesting a reservation implies commitment by the client to authorize the charge for the entire amount of the product, service or combined trip contracted.

RIGHT OF WITHDRAWAL

It is the faculty that the user has to leave without effect a contract in certain cases without needing to justify his decision or assume any penalty.

Under article 103 paragraph l) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, the right of withdrawal to contracts that refer to the provision of accommodation services for purposes other than serving as housing, transportation of goods, rental of vehicles, food or services related to recreational activities, if the contracts provide for a date or period Specific execution.

With regard to combined trips, Article 160 of the same legal text provides that the USER may at any time cease the requested or contracted services, having the right to the return of the amounts he had paid, but must indemnify the organizer or to the retailer in the following amounts, unless such resolution takes place due to force majeure

The cancellation of the trip, for any reason that is not attributable to the consumer, entitles you to terminate the contract with the rights provided.

If the cancellation of the trip is communicated within two months prior to departure, Touristair must pay the consumer compensation based on the time remaining for departure, which will be at least:

a) 5% of the price of the trip if it occurs more than 15 days in advance and less than 2 months.

b) 10% of the price of the trip, if it takes place between 15 and 3 days in advance.

c) 25% of the price of the trip, if it occurs within 48 hours prior to departure.

If they do not show up on departure, the consumer and user is obliged to pay the total amount of the trip, paying, if applicable, the outstanding amounts unless otherwise agreed between the parties.

In the event that the combined trip is subject to special economic conditions of hiring, such as freight of airplanes, ships or special rates, the cancellation costs will be established in accordance with the conditions agreed between the parties.

There is no obligation to indemnify in the following cases:

a) When the cancellation is due to the fact that the number of people registered is lower than that required in the brochure or in the contract for the combined trip.

In this case, the agency must communicate in writing the cancellation to the consumer before the deadline set in the brochure or in the contract.

Otherwise, the agency must notify the cancellation at least ten days before the date of departure.

b) When the trip cancellation is due to force majeure reasons. Causes of force majeure are circumstances outside the agency, abnormal and unpredictable whose consequences could not have been avoided, despite having acted with due diligence.

INTELLECTUAL AND INDUSTRIAL PROPERTY

Touristair itself or as an assignee, is the owner of all the intellectual and industrial property rights of its website, as well as the elements contained therein (by way of example, images, sound, audio, video, software or texts; brands or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by Touristair or its licensors. All rights reserved. By virtue of the provisions of articles 8 and 32.1, second paragraph, of the Law on Intellectual Property, the reproduction, distribution and public communication, including its method of making available, of all or part of the provisions of the contents of this website, for commercial purposes, on any support and by any technical means, without authorization Touristair.
